b) Conclusion of the Contract

The contract is concluded when the customer places the order and the order confirmation is sent. A valid contract is not created in cases where the images submitted by the customer contain adult content and/or may not be distributed pursuant to other statutory provisions. This includes, in particular, pornographic images and images included in the list set forth in Section 15(2) of the Protection of Young Persons Act. The upload of this kind of material to the Server of shield-factory.com is expressly prohibited. If, on the basis of this provision, a contract is not concluded, the parties must surrender any services already received.

2. Payment and Prices

The purchase price is due upon completion of the order process and is payable in advance. All prices stated on our website are end-customer prices and include Sales Tax. Any taxes and charges that may be levied by foreign authorities where goods are delivered to addresses outside Germany are not included in the price. Please contact the relevant authorities for your delivery address to find out whether such fees will be incurred and, if so, the amount thereof.

3. Delivery and Performance

The Static-Shields are created in all cases only after payment has been received. We deliver the goods as soon as possible by post.

4. Cancellation Policy

a) Cancellation Right

You can cancel your contract for our StaticShield products with our prefabricated designs in writing (e.g. letter, fax, e-mail) within two weeks, without the need to state reasons, or, if you have already received the goods by returning the goods before the two-week period expires. The period begins upon receipt of this written notice, but not before receipt of the goods by the recipient and not before fulfillment of our information duties under Section 312c (2) Civil Code (BGB) in combination with Section 1 (1), (2) and (4) BGB Ordinance on Information Duties, as well as our duties pursuant to Section 312e (1) sentence 1 BGB in combination with Section 3 BGB Ordinance on Information Duties. It is sufficient to send the cancellation or to return the goods within the time period. The cancellation should be addressed to:

b) Effects of Cancellation

Where a contract has been effectively cancelled, the services received by both parties are to be returned and any benefits received (e.g. interest) to be surrendered. If you are unable to return the service in full or in part, or in a deteriorated condition only, you will be required to this extent to provide compensation. In the case of surrender of goods, this does not apply if the deterioration is attributable solely to the examination thereof e.g. within the store. Otherwise, you can avoid compensation obligations for deterioration caused by correct use of the item by handling the item as if it were not your own property and refraining from any actions that could affect its value.

Items that can thus be sent are to be returned by post. You are required to bear the costs of the return if the goods supplied correspond to those ordered and the price of the item to be returned does not exceed EUR 40 or, in the case of a higher price, the consideration or contractually agreed installment has not been rendered at the time of the cancellation. Otherwise, the return is free of charge. Items that cannot be sent by post shall be collected. Obligations to reimburse payments must be fulfilled within 30 days. The time period begins for you upon sending your cancellation declaration or this item, and for us upon receipt thereof.

c) Special Notices / Made-to-order items

Unless otherwise provided, the cancellation right pursuant to Section 312d (4) No. 1 BGB does not apply to distance contracts for the supply of made-to-order or obviously customized goods. Accordingly, the cancellation right does not apply to our StaticShield products that are printed with graphics specified by the customer. This does not affect the customer's general warranty claims. 6. Supplementary Performance and Rescission

ideas-by Jastram & Bruns GbR may, at their discretion, remedy defects, supply a new item or, in the case of work, perform new work. ideas-by Jastram & Bruns GbR has the right to carry out two attempts at supplementary performance, unless a second supplementary performance would be unreasonable for the customer. The supplementary performance must be carried out within a reasonable period of time. If ideas-by Jastram & Bruns GbR performs new work or supplies a new item, it may request that the customer surrender the defective work or the defective item and demand compensation for the benefits received. ideas-by Jastram & Bruns GbR may refuse supplementary performance if this would entail unreasonably high costs. In deciding this, the value of the non-defective item and the importance of the defect are to be taken into account. The customer's rights to rescission and reduction of the purchase price remain unaffected. In the event that supplementary performance is unsuccessful, the customer has the right to a reduction in the purchase price or to rescind the contract. In the event of rescission, ideas-by Jastraqm & Bruns GbR and the customer are obligated to surrender the services and benefits received by each of them.

7. LImitation of Liability

ideas-by Jastram & Bruns GbR is liable in full in cases of intentional damage, gross negligence or damage to life, limb or health. ideas-by Jastram & Bruns GbR is also liable for the breach of a material contractual obligation. Otherwise, liability for simple negligence on the part of ideas-by Jastram & Bruns GbR, its representatives and agents is excluded.

8. Data Protection
The data provided by you shall be stored for order processing purposes. For this purpose we require:

Name and surname,
delivery address,
e-mail address.

On completion of the order process you will be sent an e-mail containing the order confirmation; this e-mail contains the information stored by us. The data shall not under any circumstances be passed on to third parties, unless required by mandatory statutory obligation or court order.

9. Side Agreements

Any side agreements to, or amendments of, these general terms and conditions must be confirmed in writing. This also applies to the amendment of the written form requirements.
